Orders

The Student Judiciary can adopt two basic types of Orders - General Orders and Orders in Cases.

General Orders are administrative actions taken by the Judiciary that are unrelated to any cases or other judicial actions, and are adopted either by the Resolution in a meeting or published by a justice (usually the Chief Justice) delegated authority to do so. Examples include setting semester meeting times, creating committees, or actions regarding elections.

Orders in Cases are judicial actions taken by the Judiciary relating to pending cases. These are responses to petitions or motions from parties and are adopted either by the panel hearing the case or by the Judiciary as a whole. There are three basic subsets -

Preliminary Relief are orders by the Chief Justice, or a panel, granting or denying a "freeze" of the status quo surrounding a recently filed case to prevent what is called "irreparable harm" to one or more of the parties. Examples would be stopping the certification of election results when a an election complaint is pending.
 

Motion Orders are orders either grant or deny some specific motion, such as recusal of a justice, delaying a hearing, orders requiring the disclosure of evidence, etc.
 

Appeal Orders are orders adopted by the full Judiciary to either grant or deny an appeal in a previously decided case.

The Orders listed here may not be the complete list of all ASM Student Judiciary Orders, as this service to the membership is under construction. People wishing to have official copies should contact the Chief Justice and request copies of the official hard copies. Web based copies are only precedent to the extent that they correspond to the official copies in the ASM office.
